THE SIMS™ SPARK’D COMMUNITY CHALLENGE
OFFICIAL RULES
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR CLAIM PRIZE. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.
1. CHALLENGE OVERVIEW. The objective of The Sims Spark’d Community Challenge series (each a “Challenge”) is to offer the game’s fan base new ways to play the game and to showcase their creativity. The theme of each Challenge will be communicated on the applicable Challenge event page (the “Theme”). To win a Challenge, you must meet the eligibility criteria set forth in Section 3 of these Official Rules and your creation must reflect the Theme as well as best exemplify the judging criteria set forth in these Official Rules. There are three variations of creations you can submit for each Challenge:
a. Stylist. Channel your inner fashion guru! Design a creation that showcases the clothing, accessories, and styling capabilities of the game.
b. Builder. Utilize the Build/Buy mode and lot construction to design a creation that showcases the architectural capabilities of the game.
c. Storyteller. Implement Live Mode to bring the game to life. Design a compelling story of no more than 3 minutes that includes a beginning, middle, and end.
2. TIMING. Each Challenge has a start and end date (the “Challenge Period”). For each Challenge, the Challenge Period is set forth on the event page. Days shall be calculated on the basis of U.S. pacific time (“PT”). Creations that are submitted before or after the Challenge Period will not be judged.
3. ELIGIBILITY. To win a Challenge, you must be at least 18 years of age (or at least the minimum age of majority in your place of residence, whichever is greater) as of the start of the Challenge Period. Residents of Cuba, Iran, North Korea, the Sudan, Syria, Burma/Myanmar, or other countries that are restricted for businesses based in the United States are not eligible to participate in the Challenge. Employees and agents of Sponsor and its affiliates, agencies, and members of such employees’ and agents’ immediate families and individuals living in the same household with such employees, are not eligible to enter or win a Challenge. Void where prohibited or otherwise restricted by law.
4. TO SUBMIT A CREATION. During each applicable Challenge Period, as set forth on the Challenge event page, assess the Theme and decide whether you would like to design a creation as a stylist, a builder, and/or as a storyteller. Then, complete and submit your creation as follows:
a. Stylist. Upload your creation to the “Challenge Gallery.”
b. Builder. Upload your creation to the “Challenge Gallery.”
c. Storyteller. Upload your creation to YouTube as “public” or “unlisted.” Then, visit www.thesims.com/challenge and complete and submit the form.
All creations must be received by 11:59:59 p.m. PT on the last day of the Challenge Period. Each creation must be separately submitted. If one creation is to be judged for two different variations, submit the creation multiple times as required above for each variation. There is no limit to the number of creations or variations you can submit. However, do not submit the same creation multiple times per variation. Submitting the same creation multiple times for a single variation will not increase your chances of winning and only the first of any duplicate submissions will be judged.
5. CREATION GUIDELINES. Each creation must comply with the following guidelines (“Guidelines”). Creations that do not fully comply with these Guidelines shall be disqualified from the applicable Challenge:
a. All creations must either be in English or contain English subtitles, as applicable.
b. The creation may not contain material that violates or infringes another’s rights, including but not limited to privacy, publicity or intellectual property rights, or that constitutes copyright or trademark infringement.
c. The creation must not in any way disparage Sponsor, any of its products or services, the Challenge, or any person or party affiliated with the Challenge, or alternatively appear to promote any direct competitor of Sponsor;
d. The creation may not contain text or imagery that is inappropriate, indecent, obscene, hateful, tortious, defamatory, slanderous or libelous;
e. The creation must not include threats (expressed or implied) to any person, place, business, or group;
f. The creation must not invade privacy rights or any other rights of any person, business, or group, and the creation must not name or depict any third party without his/her permission;
g. The creation must not contain text or imagery that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age; and
h. The creation must not contain material that is unlawful, in violation of or contrary to the laws or regulations in any jurisdiction where the creation is created.
Sponsor will determine, in its sole and absolute discretion, whether a creation complies with these Guidelines. Sponsor reserves the right to disqualify any participant if Sponsor determines, in its sole discretion, that participant’s participation in any Challenge or receipt of prize would violate local law or cause damage to the reputation of Sponsor and/or any other party. Participant may be required to submit proof of his/her compliance with these Guidelines.
6. JUDGING. Creations submitted by participants who are eligible to win under the stylist and builder variations will first be judged by the Sims community. The Sims players will have the opportunity to visit the Challenge Gallery and vote on their favorite creation by “hearting” the submission at the same time the submission period begins and then closes one weeks later. The 100 stylist and 100 builder creations submitted by participants who are eligible to win a Challenge with the most votes from The Sims players will advance to the next round of judging. In the event of a tie, the creation that achieved the applicable number of votes first will advance. These creations, along with all creations submitted under the storyteller variation, will be judged by a panel comprised of EA employees as follows:
a. Creativity (40%): Use of challenge relevant materials; uniqueness of submission (e.g. how original and innovative); expression of ideas (how easy your theme is to grasp); “wow” factor (how much of a wow factor the submission has at first glance).
b. Ambition (30%): Attention to detail; technical ability (submission displays advanced techniques); submission goes above and beyond requirements.
c. Aesthetics (20%): All aspects of the submission seem thoughtful and deliberate; the components of the submission feel overall harmonious.
d. Overall Impression (10%)
The participants who are eligible to win and submitted the 30 highest scoring creations in each variation will be deemed the potential “Top Spark’d Creators.” In the event of a tie, the creation that scored the highest in the Overall Impression category will be deemed a Top Spark’d Creator. The odds of winning depend upon the number of eligible entries received and relative skill of participants.
7. PRIZE. Each Top Spark’d Creator will:
a. Be deemed a named Top Spark’d Creator of the applicable Challenge and will be featured on www.thesims.com/challenge; and
b. Receive the opportunity to be considered to be a contestant for an upcoming season of The Sims Spark’d series (the “Series”). This opportunity is contingent upon the existence of an upcoming Series. In the event, for whatever reason, the applicable season of the Series is cancelled or postponed, or the format is modified, Sponsor will not provide any compensation or substitution for that portion of the prize. Being considered for the Series does not guarantee a Challenge Top Spark’d Creator an appearance in the Series and participant acknowledges and agrees that all such decisions relating to the Series will be in the Series producer’s sole and absolute discretion. If a Challenge Top Spark’d Creator is selected to appear in the Series, such appearance may be subject to additional terms and conditions.
8. PRIZE NOTIFICATION AND WINNER CONFIRMATION. Each potential Top Spark’d Creator will be notified by E-mail on or about two weeks after conclusion of the Challenge Period and may be required to sign a release of eligibility (which affirms that he/she has complied with these Official Rules) as well as a publicity release, each of which, if issued, must be completed, signed, and returned within fourteen (14) days from date of issuance, or the prize may be forfeited and awarded to an alternate Top Spark’d Creator. If any prize, prize notification or attempted notification is returned as undeliverable, the prize may be forfeited and may be awarded to an alternate Top Spark’d Creator. Except where prohibited, acceptance of a prize constitutes each Top Spark’d Creator’s consent to use of his/her EA ID without further compensation for advertising, promotional, and publicity purposes by Sponsor, including in a Challenge winner’s list. By accepting the prize, each Top Spark’d Creator acknowledge(s) their eligibility to win and their compliance with these Official Rules. Sponsor is not responsible for any change of email address, mailing address, and/or telephone number of participants. Prize is provided “as is” and without any warranty of any kind. Prize is non-transferable. No cash redemption or prize substitution is allowed by any Top Spark’d Creator. Sponsor reserves the right to substitute prize of equal or greater value if advertised prize becomes unavailable. Limit one (1) prize per participant per Challenge.
9. PERMISSION TO USE. By participating, each participant gives a Sponsor, its designees, successors, assigns and licensees a royalty-free, irrevocable, non-exclusive worldwide license to use, reproduce, modify, publish, create derivative works from, and display the creation and all elements embodied therein, along with the Participant’s name and/or account name, in any manner, in whole or in part, on a worldwide basis, and to incorporate it into other works, in any form, media or technology now known or later developed, including for advertising, promotional, marketing and other purposes, without further payment, consideration, notification, or permission. If requested, participant will sign any documentation required for Sponsor or its designees successors, assignees and licensees to make use of the non-exclusive rights participant is granting to use the creation. Participant represents and warrants that the creation does not violate or infringe upon the copyright, trademark, or other intellectual property rights, publicity rights, or any other rights of any third party. Participant hereby waives any and all moral rights in a creation in favor of Sponsor.
10. DATA PRIVACY. Sponsor will be collecting personal data about participants as part of a Challenge, in accordance with its Privacy and Cookie Policy, available at https://privacy.ea.com (“PCP”). By participating in a Challenge, participants agree to Sponsor’s collection and use of their personal information according to the PCP and/or acknowledge that they have read the PCP. Challenge submissions may be made publicly available as part of Sponsor’s judging criteria. If a participant is selected as a Top Spark’d Creator, their information may also be included in a publicly-available winner’s list. Sponsor will consider all information submitted within a Challenge as attributed to fictional characters; Sponsor does not solicit or expect that participants will provide any special (sensitive) categories of personal information as part of their Challenge submission. The information that the Sponsor collects from a participant may be transferred, processed, and stored outside the European Economic Area and the Sponsor will take all steps reasonably necessary to ensure that personal data is treated securely and in accordance with the PCP.
11. TAXES. Any valuation of the prizes stated above is based on available information provided to the Sponsor. The value of the prizes, if any, will be taxable to each Top Spark’d Creator as income. All federal, state and local taxes and any other costs and expenses associated with the acceptance and/or use of a prize are solely the Top Spark’d Creator’s responsibility.
12. OTHER CONDITIONS. By participating, participants agree to these Official Rules, which are final and binding in all respects and are subject to all federal, state and local laws and regulations. Sponsor reserves the right, at its sole discretion, to modify or suspend any Challenge or any portion hereof, or to disqualify any individual implicated in any of the following actions, if for any reason: (a) infection by computer virus, bugs, tampering, unauthorized intervention, actions by participants, fraud, technical failures, or any other causes which, in Sponsor’s sole opinion, corrupt or affect the administration, security, fairness, integrity or proper conduct of the Challenge, (b) the Challenge or any website associated therewith (or any portion thereof) becomes corrupted or does not allow the proper processing of entries per these Official Rules, or (c) the Challenge is otherwise not capable of running as planned by Sponsor. By entering, participants agree to release and hold harmless Sponsor, its subsidiaries, affiliates, divisions, advertising and promotional agencies, wholesalers and retailers, and each of the foregoing entities’ employees, officers, directors, shareholders and agents (collectively the “Released Parties”), from and against any and all claims, actions and/or liability for any injuries or death, loss or damage of any kind arising from or in connection with participation in and/or entry into a Challenge or acceptance or use of any prize and for any claims based on publicity rights, defamation, invasion of privacy, and intellectual property. The Released Parties are not responsible or liable for any incorrect or inaccurate entry information, and assume no responsibility for (i) any error, omission, interruption, defect or delay in operation or transmission at any website, (ii) failure of any creation to be received by Sponsor due to technical problems, human error or traffic congestion on the Internet or at any website, (iii) communications line, hardware and/or software failures, (iv) damage to any computer (software or hardware) resulting from participation in a Challenge, (v) theft or destruction of, tampering with, unauthorized access to, or alteration of entries and/or entry information, or (vi) entries/mail which are late, lost, stolen, damaged, illegible, unintelligible, misdirected, mutilated, incomplete and/or postage due (or any combination thereof). The use of third-party software or website or automated entry systems to participate is prohibited, and Sponsor reserves the right to disqualify entries made in such fashion. Any participant who attempts to tamper with any Challenge in any way shall be disqualified from that or any Challenge. In the event of dispute as to who submitted a creation, the creation will be deemed submitted by the Authorized Account Holder of the email address submitted at the time of entry. “Authorized Account Holder” is defined as the natural person assigned to an email address by an Internet access provider, on-line service provider or other organization responsible for assigning email addresses for the domain associated with the email address in question. Additional restrictions may apply.
13. DISPUTES. BY PARTICIPATING IN A CHALLENGE, EACH PARTICIPANT AGREES THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (1) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED (IF ANY), BUT IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE; (2) UNDER NO CIRCUMSTANCES WILL ANY PARTICIPANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND PARTICIPANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT OF POCKET EXPENSES), AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (3) PARTICIPANT’S REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND PARTICIPANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO EVERY PARTICIPANT.
These Official Rules and the Challenge are governed by US law and are subject to all applicable federal, state and local laws and regulations. All issues and questions concerning the construction, validity, interpretation, and enforceability of the Official Rules, or the rights and obligations of each participant and Sponsor in connection with any Challenge, shall be governed by, and construed in accordance with, the laws of the State of California, U.S.A., without giving effect to the conflict of laws rules thereof, and any matters or proceedings shall take place in the State of California, in the City of Redwood City. For residents of jurisdictions outside of the United States: All disputes arising out of, connected with, or relating in any way to any Challenge shall be finally resolved by arbitration under the ICC (International Chamber of Commerce) Rules. There shall be one arbitrator. Except where prohibited by law, the legal place of arbitration shall be the state of California, United States. The language to be used in the arbitral proceedings shall be English. The governing law of the contract shall be the substantive laws of United States.
